3. LINKS TO OTHER WEBSITES AND SOCIAL MEDIA
If you select (click) on a third-party advertisement or other third-party content on our website, you may be directed to a third party's website (URL), and you visit those sites at your own risk. We strongly advise you to review the privacy policy of every website you visit, because their terms of use and privacy policies will apply, not ours. We do not monitor or review, and we are not responsible for, websites or webpages owned, controlled, managed or operated by third parties, including our own service providers, and consequently we cannot be and are not responsible for their privacy practices or policies.
If you choose to follow a link on our website that leads to a social networking platform, depending on the platform and your settings, if you post or enter information or interact with the platform or others, that information may also be visible to others, and again you do so at your own risk. Once you leave our website, your personal information and any activity or transactions you engage in will be under their control and subject to their policies, not ours. Like all other third-party links, we have no control over and are not liable or responsible for any use of your information by or through any social networking platform.
Our website may also contain videos from external platforms, which are video hosting, sharing and services platforms (for example, but not limited to, YouTube, operated by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043). These videos may be embedded on our website with the aid of a plugin, a program that allows you to view the videos directly through our website. Although they appear on our website, your browser may establish a direct connection to the external platform's servers and the platform may detect the websites you have accessed, including ours. If you have an account with that external platform, the platform may also be able to associate this information with your user account. You may be able to avoid this by logging out of your external platform account before viewing the videos (which use these plugins), but to be sure you should consult the external platform's privacy policy and terms of use, since that is the only source of accurate information regarding your rights and obligations in relation to their websites and platform.

The provision of these data is voluntary; without consent we will not process your personal data for these purposes. You can withdraw your consent at any time using the unsubscribe link in any marketing message, by updating your marketing preferences in your account, or by contacting us. Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal.

Legal basis: legitimate interest in understanding and improving our business, or consent where cookies requiring consent are used.
- (i) Security, fraud prevention and dispute resolution.
We use device, order, payment and correspondence data to detect and prevent fraud, abuse and security incidents, to verify transactions, and to investigate chargebacks and violations of our terms.
Legal basis: our legitimate interest in protecting our business and our customers, and compliance with legal obligations.
We do not make decisions about you based solely on automated processing that produce legal effects or similarly significantly affect you. Where our advertising relies on profiling, we do so on the basis of your consent, and you may withdraw it at any time.
6. COOKIES AND SIMILAR TECHNOLOGIES
We and our service providers use cookies and similar technologies (such as pixels, tags and local storage) to operate the website, remember your preferences, measure performance, and show you relevant advertising. Where we use the term "cookie" below, we mean any and all tracking and data-gathering technology used by our website.

- You can change or withdraw your consent at any time by opening "Cookie settings" in the footer of the website.
- You can also control cookies through your browser settings, and opt out of personalized advertising through the industry tools available in your region, such as the Digital Advertising Alliance (United States) or Your Online Choices (EU/UK).

7. SMS TEXT MESSAGING
If you provide us with a mobile phone number (a "Mobile Number"), whether by email, on our website, by interacting with our customer service representatives, or by entering it as part of your profile information when you set up an account with us, you are representing to us that the Mobile Number you provide has been assigned to you in connection with an account you have with your wireless carrier, or that you have the unrestricted right and authorization from the account owner to use the Mobile Number assigned to that account, including the right to send and receive SMS (text messages), referred to below as "Text Messages". If you are no longer an authorized user of the Mobile Number you provided to us, you agree to notify us immediately at service@airmsen.com.
Consent to receive Text Messages
By providing a Mobile Number you are consenting to our sending a Text Message to the Mobile Number you provide to us, and we will require you to expressly opt in to receiving Text Messages from us, even if that Mobile Number is registered on any State or Federal/National "Do Not Call" list. The first Text Message we may send you will include our name and an indication that subsequent Text Messages may be promotional or marketing-related, and, if you have an account with us, information related to your account and any transactions initiated in connection with it.
If you request information from us or contact our customer service representatives and provide a Mobile Number, we may also send you Text Messages that respond to your request. Message and data rates may apply depending on the wireless carrier and service plan you have. We may also use automated technology, such as an auto dialer or automated system, to send you promotional or marketing-related Text Messages.
When we send you the first Text Message, we will ask you to reply "YES" to consent to receiving Text Messages from us in the future. If you do not reply "YES", or you reply "NO", reply "STOP", or simply do not respond at all, we will understand that you do not wish to receive any further Text Messages from us. By replying "YES" you give us your express written confirmation that you consent to allow us to send you Text Messages in the future. Each Text Message will include our name, a reminder that you can opt out and that message and data rates may apply, and the marketing, customer service, account or transaction information that is the reason for sending it. We may also provide your Mobile Number to third-party customer service, technical support and other operational service providers with whom we have contracted in order to provide you with service on our behalf, and we authorize them to do so only in compliance with these terms.
You can opt out at any time
You can opt out of receiving Text Messages from us by replying to any future Text Message with the word STOP. We will send you a Text Message confirming that we have received your opt-out request, and will no longer send you Text Messages once it is processed. You can reply HELP for help at any time. Message and data rates may apply.
No mobile information will be shared with or sold to third parties or affiliates for marketing or promotional purposes. Text Messaging originator opt-in data and consent are excluded from all categories of information described in this Policy, and will not be shared with or sold to any third parties.

The safety and security of your information also depends on you. Where we have provided you with, or you have chosen, a password to access our website or services, you are responsible for keeping it secret and for complying with any other security procedure we inform you of. Please do not share your password with anyone.
We encourage you to use caution when using the internet, as it is not 100% secure. No method of transmission or storage is completely secure, and we cannot guarantee the security of your personal information transmitted electronically. If a security incident occurs that is likely to result in a high risk to your rights and freedoms, we will notify you and the relevant authorities as required by applicable law.
9. HOW LONG DO WE STORE YOUR INFORMATION FOR
We will keep your personal information only for the length of time necessary to achieve the purposes for which it was collected, or for any other related and lawful purpose. Therefore, if your personal information is processed for two different purposes, we will keep the data until the lengthier purpose is achieved. However, we will cease to process the personal information collected for the purpose whose retention period has expired.
We limit access to your personal information to only those individuals who need to use it for the appropriate purposes. When your personal information is no longer required, or when there is no longer any legal precondition for keeping it, it will be irreversibly anonymized or securely destroyed.
The retention periods relating to the different purposes described above are as follows:
- (a) Compliance with contractual obligations: data processed to comply with any contractual obligation is kept for the duration of the contract and in any case no longer than the subsequent 7 years, in order to verify any outstanding issues, including accounting documents such as invoices, and to comply with tax and accounting obligations.
- (b) Operational management and strictly related purposes for access to the website: data processed for these purposes is kept for the duration of the contract, and in any case no longer than the subsequent 7 years.
- (c) Customer satisfaction surveys: data processed for these purposes is kept for 5 years from the date of collection of the personal information, except where you decline to receive further communications.
- (d) Marketing purposes, including profiled marketing: data processed for marketing purposes is kept for 5 years from the date on which you provided your consent, except where you decline to receive further communications; for profiled marketing purposes, data is kept for 12 months.
- (e) In the event of disputes: where it is necessary for us to defend ourselves, or to take action or bring claims against you or any third party, we may keep the personal information we reasonably deem necessary for such purposes for the length of time it takes to pursue the claim.
- (f) Cookies and similar technologies: as set out in our cookie banner and cookie list, typically up to 26 months for analytics cookies and up to 13 months for advertising cookies.
The periods above are our standard defaults. Please confirm them against your actual practice before publishing, and adjust where your tax or accounting rules require a different period.

If you are in Canada, we handle your personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial law, including Quebec's Law 25. This Policy is intended to comply with the requirements of those laws, and we will not collect, use or disclose your personal information without your knowledge and consent, except where permitted or required by law.
You may withdraw your consent to the collection, use or disclosure of your personal information at any time, subject to legal or contractual restrictions and reasonable notice, and you may request access to, or correction of, the personal information we hold about you. To make a request, contact our Privacy Officer at service@airmsen.com. We will respond within 30 days. If we cannot grant your request, we will explain why and tell you about your options, including how to challenge our decision with the Office of the Privacy Commissioner of Canada or, for Quebec residents, the Commission d'accès à l'information du Québec.
Our Privacy Officer can be reached by email at service@airmsen.com.
17. YOUR PERSONAL INFORMATION PROTECTION RIGHTS AND YOUR RIGHT TO FILE COMPLAINTS BEFORE THE SUPERVISORY AUTHORITIES
Depending on your country or state of residence, you have certain rights regarding the personal information we hold about you, and certain choices about what personal information we collect from you, how we use it, and how we communicate with you.
These rights include the possibility for you to request:
- access to your personal information, meaning that you have the right to request that we disclose what personal information we have collected, used and disclosed about you;
- a copy of the personal information you have provided to us, and to request that the Company transmit your personal information to another controller (portability);
- the adjustment or correction of data in our possession;
- the deletion of any data for which the legal precondition for processing no longer exists;
- to opt out of marketing communications we send you at any time;
- to object to, or deny, processing for direct marketing purposes;
- to restrict or object to the further processing of your personal information;
- to revoke your consent, in cases where the processing is based on consent;
- to limit the way in which we process your personal information.
If you are in the EEA, the United Kingdom or Switzerland, you also have the right to lodge a complaint with the supervisory authority in your country of residence, place of work or where the alleged infringement occurred. For the United Kingdom this is the Information Commissioner's Office (ico.org.uk).
You will not receive any discriminatory treatment when you exercise one of your privacy rights.
You can exercise any of the above rights by contacting us using the contact details in Section 20. The exercise of the above rights is subject to certain exceptions provided by law that are intended to safeguard the public interest (for example the prevention or identification of crimes) and our interests (for example maintaining professional secrecy). We will check that you are entitled to exercise the right you have requested, and will usually respond within one month (30 days). Where a request is complex or we receive multiple requests, we may extend this period, and we will tell you if we do.
18. EXERCISING YOUR PRIVACY RIGHTS
If you want to exercise any of the rights you have, you can send us your request by email to service@airmsen.com, or by regular mail to MEOMY CO LTD (d/b/a AIRMSEN), c/o Denver, Colorado, United States, marked "Attention: Privacy". Your request must also include enough information to enable us to verify that you are the individual who is the subject of your request, or to authenticate anyone else authorized to make the request on your behalf. We may request additional information or confirmation from you in order to do so.
We will generally respond to a complete and proper request, at no charge to you, within 30 days of receiving your verifiable and understandable request. If we need more time, we will notify you, and it will not be longer than another 30 days. If we send you a digital file to allow for data portability, we will use a widely used file format that should allow you to transmit the information easily.
Requests that are manifestly unfounded or excessive, in particular because of their repetitive character, may be refused or subject to a reasonable fee, in accordance with applicable law. Where we refuse a request, we will explain our reasons and tell you about your options, including how to complain to a supervisory authority.
