1. Who we are

MEOMY CO LTD, doing business as AIRMSEN ("Airmsen", "we", "us", "our"), is the data controller of the personal information collected on www.airmsen.com and when you interact with us by email, phone, web chat or other means.

This Policy applies to customers and visitors in the United States, Canada, the European Economic Area, the United Kingdom, Switzerland and other regions in which we sell. It does not apply to third-party websites, applications or services, even where we link to them.

2. What we collect

  • Identifiers: name, phone number, email address, user ID, password and similar authentication data.
  • Account and order information: account details, order history, wishlists and saved preferences.
  • Commercial information: products purchased or considered, order value, currency, discounts, delivery method and purchasing history.
  • Financial information: payments are processed by third-party payment providers. We do not receive or store your full card number, CVV or full bank account details. We receive limited data such as card type, the last four digits, expiry date, billing address and transaction status.
  • Internet and network activity: IP address, device type, operating system, browser type and version, language settings, referring URL, pages and products viewed, search terms, cart and checkout activity, and interactions with our emails.
  • Approximate location: country and city level, derived from your IP address. We do not collect precise GPS location.
  • Audio, electronic and visual information: images, audio, video or call recordings you provide to us, for example when reporting a product issue.
  • Communications and preferences: emails, chat messages, contact form submissions, product reviews, survey responses and marketing opt-in or opt-out status.
  • Inferences: product preferences or likely interest in a product line.

We do not intentionally collect sensitive personal information (such as health or biometric data, precise geolocation, racial or ethnic origin, or government identification numbers). We do not collect information from mobile applications or from connected appliances.

3. Why we use it

We process personal information to:

  • perform our contract with you: process orders, payments and delivery, and handle reports, complaints, returns, refunds and warranty claims (legal basis: performance of a contract);
  • operate your account and the website, including keeping your session and cart working during checkout (performance of a contract);
  • measure customer satisfaction and improve our services (legitimate interest, or consent where required);
  • send marketing and advertising communications, including profiling where you have specifically consented (consent, which you may withdraw at any time);
  • share data with affiliated companies for internal administration (legitimate interest) and for marketing where you have consented (consent);
  • comply with legal obligations, including tax, accounting, consumer protection and product safety, and respond to legally binding requests from public authorities (legal obligation; legitimate interest in protecting our rights);
  • maintain, improve and develop our website, products and services, and carry out internal analyses of traffic, conversion and page effectiveness (legitimate interest, or consent for cookies requiring consent);
  • detect and prevent fraud, abuse and security incidents, verify transactions and investigate chargebacks (legitimate interest; legal obligation).

We do not make decisions about you based solely on automated processing that produce legal effects or similarly significantly affect you.

4. Cookies and similar technologies

We use cookies, pixels, tags and local storage in four categories:

  • Strictly necessary: required for the website to work, including the cart, checkout and security. These cannot be switched off through our consent tool.
  • Functional: remembering your preferences such as language and region.
  • Analytics: understanding how visitors use the website. We use Google Analytics 4.
  • Marketing: measuring and targeting advertising, and linking activity across websites and devices.

We do not place analytics or marketing cookies until you have given consent, unless permitted by applicable law. You can change or withdraw your consent at any time using "Cookie settings" in the footer, through your browser settings, or through industry opt-out tools available in your region (such as the Digital Advertising Alliance in the United States, or Your Online Choices in the EU and UK). We honor Global Privacy Control (GPC) browser signals as a request to opt out of the sale or sharing of personal information and of targeted advertising where required by law.

Third parties that may set cookies through our website include Shopify (ecommerce platform and hosting), Google (analytics), Klaviyo (email and SMS) and Judge.me (product reviews).

5. SMS text messaging

If you provide a mobile number, you confirm that you are its authorized user or have the account owner's authorization to use it. Consent to receive text messages is obtained separately and expressly, including where the number is registered on any Do Not Call list. Message and data rates may apply. Reply STOP to opt out and HELP for help; we will send a text confirming your opt-out. Mobile information, text messaging originator opt-in data and consent are never shared with or sold to third parties or affiliates for marketing or promotional purposes.

6. How long we keep it and how we protect it

We keep personal information only as long as necessary for the purposes for which it was collected:

  • Contractual and operational data: for the duration of the contract and up to 7 years afterwards, for tax and accounting records.
  • Customer satisfaction surveys: 5 years from the date of collection.
  • Marketing: 5 years from the date on which you gave consent, and 12 months for profiled marketing.
  • Disputes: for as long as needed to pursue or defend a claim.
  • Cookies: up to 26 months for analytics cookies and up to 13 months for advertising cookies.

When data is no longer required, or there is no longer any legal basis for keeping it, it is irreversibly anonymized or securely destroyed.

We maintain administrative, technical and physical safeguards to protect personal information against accidental or unlawful destruction, loss, alteration, unauthorized disclosure or access. These include access restricted on a need-to-know basis, encrypted transmission (TLS) for transactions that require personal information, payment processing exclusively through PCI DSS compliant providers, and contractual confidentiality and security obligations on our service providers. No method of transmission or storage is completely secure, and we cannot guarantee the security of information transmitted electronically. Where a security incident is likely to result in a high risk to your rights and freedoms, we will notify you and the relevant authorities as required by applicable law.

7. Who we share it with

We do not sell your personal information and we do not share it for cross-context behavioral advertising. We share personal information only with:

  • our parent company, subsidiaries and affiliates within our group of companies;
  • service providers acting as data processors on our behalf: Shopify (ecommerce platform and hosting), our payment service providers (payment processing and fraud screening), our shipping carriers (delivery), Google (analytics), Klaviyo (email and SMS marketing) and Judge.me (product reviews);
  • any successor to all or part of our business in connection with a merger, acquisition, reorganization, sale of assets, insolvency or bankruptcy;
  • companies, organizations or individuals outside Airmsen where we have a good faith belief that access, use, preservation or disclosure is reasonably necessary to meet applicable law or a legally binding request, to enforce our terms, to detect or address fraud, security or technical issues, or to protect the rights, property or safety of Airmsen, our users or the public;
  • any other party where we notify you and you consent.

8. International transfers

Our servers and those of our service providers may be located in the United States, the European Union or other jurisdictions. If you are in the EEA, the United Kingdom or Switzerland, we rely on appropriate safeguards for transfers, including the European Commission's Standard Contractual Clauses, the UK International Data Transfer Addendum and/or the EU-US Data Privacy Framework where our providers are certified, together with supplementary technical and organizational measures such as encryption, access controls and data minimization.

9. Children's privacy

Our website and services are designed for adults. We do not knowingly allow individuals under the age of 18 to set up an account with us. If we learn that we have collected personal information from someone under 18 without parental consent, we will delete it.

10. Your rights

You may request to access your personal information; receive a copy of the information you provided and have it transmitted to another controller (portability); correct inaccurate data; delete data where the legal basis for processing no longer exists; object to or opt out of direct marketing; restrict or object to further processing; withdraw your consent where processing is based on consent; and limit the way we process your information. You will not be treated differently for exercising any of these rights.

California residents (CCPA/CPRA): you have the rights to know and access, to delete, to correct, to opt out of the sale or sharing of personal information, to limit the use of sensitive personal information, to be free from discrimination, and to use an authorized agent. We have not sold personal information and we do not share it for cross-context behavioral advertising. We honor opt-out preference signals such as Global Privacy Control. We may offer financial incentives such as coupons, discounts or vouchers in exchange for enrolling in our emails or newsletter; the value of the incentive is reasonably related to the value of the personal information you provide, and you can opt out at any time.

Other US states: residents of states with comprehensive privacy laws, including Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah and Virginia, may have rights to access, correct, delete and obtain a copy of their personal information, to opt out of targeted advertising and of the sale of personal information, and to appeal a decision we make about a request. If we deny a request, you may appeal by replying to our response with the word "Appeal".

Canada: we handle personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial law, including Quebec's Law 25. Our Privacy Officer can be reached at service@airmsen.com and will respond within 30 days. You may challenge our decision with the Office of the Privacy Commissioner of Canada or, for Quebec residents, the Commission d'acces a l'information du Quebec.

EEA, United Kingdom and Switzerland: you have the right to lodge a complaint with the supervisory authority in your country of residence, place of work or where the alleged infringement occurred. For the United Kingdom this is the Information Commissioner's Office (ico.org.uk).

Please include enough information to allow us to verify that you are the person the request relates to. We respond to a complete and proper request at no charge within 30 days, and we will tell you if we need a further 30 days. Requests that are manifestly unfounded or excessive may be refused or subject to a reasonable fee; if we refuse, we will explain our reasons and tell you about your options, including how to complain to a supervisory authority.
